The acceptance of Tripresale's privacy policy (hereinafter "Privacy Policy"), is a necessary condition for the use of our booking resale service (hereinafter the "Service").

This Privacy Policy governs the collection, processing and use of your personal and non-personal information as a user of Tripresale, as of the effective date shown in the heading.

In processing your personal data, Tripresale complies with current local and European legislation, as well as its implementing regulations.

2.- Information gathered

The Service can be used without providing any data, although in order to fully enjoy the Service you will need to provide us with some personal data. The information (personal or non-personal) collected by the Service may vary accordingly.

Personal and non-personal information collected by the Service will come to us in three ways: 1) information collected automatically, 2) information you voluntarily provide to us, and 3) information provided by third parties.

2.2.- That which you provide voluntarily

This information will consist of:

• The information, personal or not, that could contain the messages sent through the contact channels established in the Service, for example your name, email and message.

All data are mandatory.

We inform you that the completion of the forms is voluntary. However, if you do not fill in the mandatory fields (usually marked with an asterisk), the use of some functions of the Service will not be possible or will be limited.

The personal data you provide will be included and processed in the Register of Processing Activities owned by Tripresale, among others, in order to be able to respond to your requests, provide the requested service and keep you informed on matters relating to the activity of the company and its services.

In addition, if you consider that there is a problem with the way Tripresale is handling your data, you can address your complaints to the appropriate data protection authority, being the Spanish Data Protection Agency the one indicated in the case of Spain.

4.- Age

With respect to your use of the Service, you represent that you are of legal age and have the legal capacity to be bound by this agreement and to use the site in accordance with its terms and conditions, which you fully understand and acknowledge.

You represent that all information you provide to access the Service, before and during its use, is true, complete and accurate.

5.- Use of data

Tripresale will use the data collected to:

• Administer, provide and update the Service (the legal basis being the contract).
• Manage the relationship with the client in the whole process and facilitate the resale of the reservation (the legal basis being the contract).
• Address the issues you raise, such as queries, complaints, claims and / or suggestions obtained from the contact channels for customer service (the legal basis being our legitimate interest in meeting the requests of our users or the contractual relationship).
• Manage the creation, update or deletion of your account on the platform (the legal basis being your consent).
• Process the payments you make (the legal basis being the contract).
• Share data such as your image on our social networks (the legal basis being our legitimate interest in the dissemination and promotion of our products or your consent).
• Send you by e-mail our newsletter and promotional offers (the legal basis being your consent or our legitimate interest based on the previous contractual relationship, as the case may be).

You will be able to unsubscribe from them from the email you receive or by contacting us at support@tripresale.com. However, you will not be able to unsubscribe from certain correspondence from us, such as messages regarding the security of your data or the terms and conditions of Service.

• To maintain the security of the Service, investigate illegal activities, enforce our terms and conditions and assist law enforcement agencies in their investigations (the legal basis being our legitimate interest in ensuring and maintaining the security of the Service and its users).

Tripresale does not use automated decisions, although it may generate basic user profiles, the legal basis being our legitimate interest for commercial purposes and to provide personalized offers.

Tripresale may also use user information in the form of aggregated and anonymous data to display to third parties. We may also share statistics and demographic information about users and their use of the Service with third parties. But none of this will allow those third parties to identify you personally.

5.1.- In mails and contact forms

The Service's website has a TSL encryption that allows the user to securely send your personal data through standard contact forms.

The personal data collected will be subject to automated processing and incorporated into the relevant files of the register of processing activities and of which Tripresale is the owner.

In this sense:

• We will receive your IP, which will be used to check the origin of the message in order to provide you with appropriate recommendations (e.g. to present the information in the correct language) and to detect possible irregularities (e.g. possible attempts of cyber-attack on the Service), as well as data concerning your ISP.
• You may also provide us with your data by telephone, e-mail and other means of communication indicated.

Regarding the media used:

• Our payment service providers for payment of the service are VISA, Mastercard, through a secure payment gateway. At no time will the Service or its staff have access to the bank details (e.g. credit card number) that the user as a customer provides to these third parties.

On the other hand, certain services provided through the site (for example, the possibility of participating in a contest or promotional code sweepstakes) may contain special conditions regarding the protection of personal data. It will be necessary to accept them before participating in these services.

5.2.- In social networks

Tripresale has profiles on some of the main social networks, being responsible for the treatment in relation to the data published on them (for example, photos uploaded by Tripresale in which people's faces appear).

The treatment that Tripresale will carry out with the data within each of the referred networks will be, at most, the one that the social network allows to the corporate profiles. Thus, Tripresale will be able to inform, when the law does not prohibit it, to our followers by any way that the social network allows about its products or offers, as well as to provide a personalized customer service.

In no case will Tripresale extract data from social networks, unless the user's consent to do so is expressly and timely obtained.

5.3.- In draws

When participating in promotional actions organized exclusively by Tripresale, the data you provide will be processed only by us for the purpose indicated in the action's statement and its corresponding legal conditions.

6.- Data retention

The following is an indication of how long the data processed by the Service is retained:

• Disaggregated data will be retained with no time limit for deletion.
• Customer data will be retained as little as necessary, and may be kept until:
• 5 years, according to art. 1964 of the Civil Code (personal actions without special term).
• 6 years, according to art. 30 of the Commercial Code (accounting books or invoice, for example).
• The data of newsletter subscribers will be retained from the time the user subscribes until the user unsubscribes.
• User data uploaded to social networks will be retained from the time the user gives consent, or the data has been uploaded in accordance with Tripresale's legitimate interest, until it is withdrawn.

7.- Data shared with third parties

There are third parties that manage part of the Service.

They are required by Tripresale to comply with this Privacy Policy to the extent applicable to them, in addition to having their own. However, Tripresale will not be responsible for their compliance with this policy.

Under some circumstances, Tripresale may share, use or preserve some of the personal information collected with third parties:

Service providers that perform functions on our behalf, such as payment services, web hosting, business analytics, booking engine, hotel, customer service or marketing. In any case, Tripresale cannot guarantee the absolute security of the information collected, so you must cooperate and use common sense at all times about the information shared.

You understand and acknowledge that, even after deletion, personal and non-personal information may remain visible in cache or if other users have copied or stored it.
